Chevron Cape Town Refinery

Chevron South Africa (Pty) Ltd applied for an integrated Waste Management Licence from the Department of Environmental Affairs (DEA) in 2010 in order to authorise existing and future waste management activities at the Chevron Refinery in Milnerton, ERF 936, Cape Town. The application was in accordance with section 20 (b) of the National Environmental Management: Waste Act, 2008 (Act no. 59 of 2008) The license (No. 12/9/11/L287/9) was issued, dated 25/08/2011, however the decommissioning of the existing facilities was not authorised, as it had not been included in the original application form (submitted 13/05/2010). For this reason a separate application process is being undertaken to apply for authorisation to decommission existing facilities. Please note that although this activity was not included in the list of activities applied for, this aspect was dealt with in the original BAR and public participation process. This Basic Assessment Report therefore remains the same as the previous BAR released and submitted in 2011, but includes an indication of which sections need to be considered for this application specifically.

The relevant activity is listed in Category A of the Schedule of Waste Management Activities (GN 718 of July 2009). Category A activities require a Basic Assessment (BA) as per the Environmental Impact Assessment (EIA) Regulations made in terms of NEMA (Act No. 107 of 1998).

The Department of Environmental Affairs (DEA) issued a Waste Management Licence (WML), in terms of Section 49(1)(a) of the National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008), to Chevron South Africa (Pty) Ltd for the decommissioning of existing waste storage facilities for the temporary storage of waste at the Chevron Refinery, Erf 936, Milnerton. The WML was issued on 30 May 2013 and received on 25 June 2013.

The right to appeal is provided for in Chapter 7 of GN No. R543 of 2010 in terms of the National Environmental Management Act, 1998, as amended (see Annexure 1 of the WML).
