Brazil Announces Major Changes in its Remediation Program with Wide-Ranging Impacts on Liability.
On February10th 2017, CETESB, the State of São Paulo Environmental Agency, issued a new regulation impacting the entire contaminated site management process. This new regulation is a significant change in direction since the last State Decree, published in 2013. Over the last 4 years, CETESB has engaged with numerous stakeholders to obtain input to the new program.
Numerous discussions have taken place in the six months since the passing of the regulation, with many of them addressing how to go about evaluating the regulation’s impact. There is an increased interest in understanding how industry will implement the new mandatory operational procedures, put in place by the CETESB and District Attorneys. In this one hour webinar, ERM will review key areas of the operational procedures and recommend next steps as clients prepare for the technical and legal impacts of this new Remediation Management Program.

Dr. Huggins is responsible for coordinating ERM’s site investigation and remediation services. He provides oversight to US corporations in managing domestic and overseas remediation liabilities. He is actively involved in remediation projects in Brazil for US and Brazilian companies.
Paulo Santos is a ERM Partner specialized in environmental site assessments (confirmatory, detailed and feasibility studies), remediation projects, modeling (flow and transport) and hydrology / hydrogeology projects. Mr. Santos has more than 17 years of professional experience, and has been involved in more than 50 contaminated site management projects in Brazil related to Volatile Organic Compounds, Petroleum Hydrocarbons and Heavy Metals. Remediation methods comprised soil vapor extraction, dual-phase extraction, air sparging and pump & treat. He has a BSc in Geology from the University of State of São Paulo-Unesp-1999, specialization in Project Management from FIA, 2004 and Master Degree from USP/IPT in 2008.
Mr. Martim Souza is a Principal Consultant in the ERM Brazil office with more than 21 years of experience working with complex contaminated sites from Site Assessment to Remediation. His main focus areas are in situ remediation using Bioremediation and Monitored Natural Attenuation as well as P&T, SVE, AS, MPE. Mr. Souza has an international background through technical exchanges in Germany and in Canada, as well as training in the United States. He has a BSc in Geology from the University of São Paulo-USP-1995, an MBA in Project Management from SENAC, 2009, and is a professor for the postgraduate course in Contaminated Site Management at SENAC since 2005 and for the Remediation course since 2015.
Mrs. Bianca Antacli, partner of the Environmental Group of TozziniFreire Advogados has been working in environmental law since 2001. Her experience involves, among others, greenfield projects, complex contamination cases and assistance to clients in issues involving ABS cases (access to genetic heritage and benefit sharing). Ms. Antacli graduate at Law School of Pontifícia Universidade Católica de São Paulo and has Masters' in Social Relations Law, Diffuse and Collective Rights and Environmental Law from the same University.
