USEPA’s Recently Finalized Chemical Manufacturing Area Source GACT Rule

USEPA historically has regulated major sources of Hazardous Air Pollutants (HAP) under the Clean Air Act.  However, recently USEPA has adopted regulations governing lower-emitting sources of air toxics with a stringency and administrative burden on par with the major source rules. The Chemical Manufacturing Area Source Rule, which was published in the Federal Register on October 29, 2009, will affect owners and operators of facilities classified under NAICS 325 (pharmaceuticals, specialty chemicals).

The “Generally Available Control Technology” provisions of the Rule will impose additional levels of controls on sources using as little as 0.1% of Urban HAP in its raw materials. The presentations and insights will be provided by ERM’s top air specialists in the Midwest and the session will cover the following aspects of the new Rule:

  • How is applicability determined?
  • What chemical manufacturing process units (CMPU) will be subject to emission limits or work practice standards?
  • What is my timeframe for compliance?
  • What are my recordkeeping and reporting obligations?
  • What best practices can be followed to assure compliance readiness?
  • What other area source rules are on the books or pending that I should review relative to current site operations and future projects?
